Jan Bart van de Hel

Jan Bart is a partner in our Dispute Resolution group. He is an expert in commercial and corporate dispute resolution and co-heads the Dispute Resolution group. His practice covers the  entire range of dispute resolution, with a focus on banking and finance litigation, director’s and professional liability, M&A related disputes and follow-on (cartel) damage claims. Jan Bart has extensive experience in large corporate investigations and asset recovery cases. He advises various (listed) companies and financial institutions on corporate and obligatory issues and liability.

Between 2011 and 2013 Jan Bart was a member of the Investigation Committee Meavita which, at the instructions of the Enterprise Division of the Amsterdam Court of Appeal, investigated the management and course of affairs of Meavita, a care institution that went bankrupt in 2009.

Jan Bart worked for many years as a senior lawyer in the Litigation & Arbitration and Banking & International Capital Markets departments of Allen & Overy. Jan Bart publishes regularly and is a lecturer at the Law Firm School on discovery and evidence. He is also a lecturer at the Nyenrode Business University for executives and non-executives on governance. Jan Bart is a member of the Corporate Litigation Association, the Association for Financial Law and the Dutch Association for Procedural Law.

His track record includes advice to:

• ING Bank as Security Agent in a >USD 2 billion financing and in respect of all Dutch litigation as a result of the bankruptcy of OW Bunker, the largest bunker supplier in the world that went bankrupt In 2014.
• Intertrust and Mesdag (Delta) as issuer of bonds in a >EUR 635 million CMBS-transaction, in complex proceedings against leading US hedge funds relating to the interpretation of the CMBS-documentation.
• Rabobank in respect of the internal and external investigations to it’s compliance systems and the manipulation of Libor/Euribor rates by financial institutions which has led to a EUR 774 million transaction of Rabobank with Dutch and international authorities.
• Samsung with respect to >EUR 2 billion civil damage claims proceedings from Turkish and Brazilian corporates against Samsung, Phillips, LG and Technicolor related to alleged cartel arrangements with regard to cathode ray tubes.
• ING Bank in respect of the internal and external investigation to ING’s compliance systems which has led to a EUR 775 million transaction with the Dutch Public Prosecutor in 2018.
• COFCO in relation to internal investigations and litigation regarding a >EUR 200 million loss as a result of fraud / accounting irregularities in COFCO  Netherlands’ (Nidera) bio fuels business.
• Vestia, the largest housing association in the Netherlands, in relation to complex cases and multimillion euro claims on real estate developers, board members and insolvency proceedings before the Dutch courts, all related to fraud / mismanagement.
