In the Netherlands, the energy crisis has thrown the generally applicable general conditions for the supply of electricity and gas to ‘small-scale users’, including consumers, in the spotlights. In an article in the Netherlands Journal for Energy Law Gerard de Jongh discusses the recent developments and case law with respect to inter alia the right of energy suppliers to price changes and the notice period for such changes. The author also elaborates on the consequences of the termination by the Netherlands Consumers’ Association of the so-called ‘two-sided’ nature of these general conditions.
